This document is legal document between you and Balloshi (classified website operated by Balloshi commercial and its partners, registered trade mark number 234787, Dubai) that govern your use of the website. By using and accessing Balloshi.com (website, mobile website, application) through any means, for example but not limited to,  a compute, tablet device or smart phone, and including, but not limited to, viewing, accessing, registering, posting ads, viewing ads or any other form of using the website, you represent and warrant that you have read and understood the Terms of Use and unconditionally accepts these terms and policies as they are written. . If you do not agree to any of the provisions set out in this document, you should not use the Website, mobile website, application or any of the Services provided by Balloshi.com.

General

• You agree that the fact that these Terms of Use are in electronic format does not affect in any way their validity or enforceability.
• These Terms of Use constitute the entire agreement between you and Balloshi regarding its subject matter and supersede any contemporaneous or prior oral or written agreements, representations, understandings or discussions between you and Balloshi, whether implied or express.
• The provisions of these Terms of Use shall be deemed severable, and if any provision is determined to be illegal or invalid under applicable law, such provision may be changed to the extent reasonably necessary to make the provision, as so changed, legal, valid and binding.
• You may not assign any part of these Terms of Use without Balloshi’s express written permission. Balloshi may assign these Terms of Use immediately upon posting a notice of such assignment on the Website

 

Posting policy                                                      

The following activities are prohibited from posting

• Posting an item for sale that is not located in involved countries.
• Posting an item for sale that is illegal to own, buy or sell in your area of residence.
• Posting an item or content that is in the prohibited items list. The list below details what can't be posted and prohibited:

• Any content whatsoever against Islam.
• Adult or Erotic Products and Services whatsoever 
• Alcoholic Beverages
• Blood, Bodily Fluids and Body Parts
• Burglary Tools
• Car seats that don’t meet safety measures in your country
• Counterfeit currency, stamps or coins
• Counterfeit Products
• Electronic Surveillance Equipment designed or used primarily to illegally intercept/record the private actions or interactions of others without their knowledge or permission
• Embargoed Goods
• Government and Transit Uniforms, IDs and Licenses
• Health or weight loss products that have not been approved by Heath authority in your country
• Illegal Drugs & Drug Paraphernalia (or any mention of)
• Illegal Services
• Hazardous Materials
• Fireworks, Destructive Devices and Explosives
• Identity Documents, Personal Financial Records & Personal Information (in any form, including mailing lists and pictures for example)
• Items which encourage or facilitate illegal activity (such as mod chips or modding services)
• Lottery tickets, Sweepstakes entries and slot Machines
• Any service posted by anyone who is not a registered service at your country.
• New merchandise or services from network marketing companies, independent franchisees or distributors, or similar representatives
• Offensive Material
• Pesticides
• Police Badges and Uniforms
• Prescription Drugs and Devices
• Recalled items
• Satellite products that violate the radio communication Act
• Solicitation of other users
• Stocks and Other Securities
• Stolen Property
• Taxidermied Animals
• Used Cosmetics
• Weapons and related items (such as firearms, firearm parts and magazines, ammunition, BB and pellet guns, tear gas, stun guns, knives, archery equipment, and martial arts weapons)
• Use any robot, spider, scraper or other automated means to access and collect content for any purpose without our express written permission
• Harvest or otherwise collect information about others, including email addresses, without their consent
• Bypass measures used to prevent or restrict access to Balloshi.
• Establish a hyperlink in a misleading way or as to suggest any form of association, approval or endorsement of Balloshi or any other third party where none exists.

• Posting duplicate ads in multiple categories or multiple cities
• Your ad should only be posted on the city closest to you, and in the most relevant category. Duplicate ads are not allowed and will be removed
• You should only post your ad in the most relevant category. Should you be unsure which category to use for your Ad, try searching to find out where others have put similar ads. If you post the same Ad in multiple categories, they will be removed.
• Posting an ad containing a list of keywords not directly related to the item being sold
• Posting an Ad that violates equality in housing policy (see below)
• Infringe any third-party right
• Posting Racial or discriminatory content towards any race, religion, creed, nationality, gender or any other grouping of individuals
• Posting contents that contains any software viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful
• Distribute viruses or any other technologies that may harm our website or the interests of Balloshi users
• Impose an unreasonable load on our infrastructure or interfere with the proper working of the system
• Copy, modify, or distribute any other person’s content
• Posting Ads using multiple different email addresses
• Posting ad, without our permission, using different account after you get blocked.
• Posting ad and contents using automated means (via the web interface) without our consent.

• Posting an ad that serves no other purpose other than to send traffic to a website. You can include a web site address by including a URL in the description of an Ad if you are a business and would like to:
• Link to additional product information
• Link to a page with more pictures
• Please note that such links may not be clickable and can we reserve the right to withdraw or amend the above linking permission without advance notice
• Posting a multi-level marketing or other prohibited jobs. All jobs advertised in classified ads and in reply to other ads must adhere to our job rules, as well as our regular posting policies. The following types of jobs are prohibited from being advertised on the site:
• Multi-level marketing jobs where recruitment of other members is part of the compensation
• Pyramid schemes, or jobs that require upfront or periodic payments
• Jobs that pay only commissions, unless the ad makes it clear that the sole source of compensation would be commission, and clearly describes the product or service that would be sold.
• Jobs that involve sexual activities.
• Ads that are not clear regarding what type of work would be required.
• In addition, please keep in mind that:
• Requiring a photo for an application is not permitted.
• Replies to resume ads for any purpose other than recruitment to a legitimate position are prohibited.
• Replies to resume ads for personal reasons or for solicitation of any sexual or otherwise inappropriate purposes are strictly prohibited and may result in a loss of ability to utilize Balloshi.

And just to be clear, Balloshi has the wright to remove any content that is deemed inappropriate in our view, even if it is not included in the above list, and has the wright to block that user and erase any of his/her content without any previous notice and without any responsibilities on Balloshi whatsoever that result from that action.

Equal Housing Opportunity Policy

Our website supports equality in housing. Laws prohibit denying a person housing, or discriminating in a tenancy agreement, based on the following prohibited grounds:

A property owner or manager cannot establish discriminatory terms or conditions in the purchase or rental of a residential dwelling, deny that housing is available, or advertise that the property is available only to persons of a certain gender, age, race, color, handicap, national origin, or any other prohibited ground of discrimination in force in your jurisdiction.

 

Renter's Rights:

As someone seeking to rent an apartment, home or condo, you have the right to expect that housing will be available to you without discrimination or other limitations based on the prohibited grounds of discrimination mentioned above or in force in your jurisdiction. This includes the right to expect equal professional service, the opportunity to consider a broad range of housing choices with no discriminatory limitations on communities or locations of housing and with no discrimination in the pricing or financing of housing and to be free from harassment or intimidation for exercising your rights.

Content

Balloshi contains stuff from us, you, and other users. These contents are referred to as any materials in the website including posted ads, messages, text, images, photos or any other material posted on the Website. When you give us content in anyway:

• you are granting us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable right to store, use, copy, reproduce, distribute, perform, display, modify or create derivative works of the content perpetually and for any lawful purpose Balloshi.com sees fit.
• You permit any other user of the Website to access, display, view, store and reproduce such content.
• You grant Balloshi the right to remove content where we have grounds for suspecting the violation of these terms or the rights of any other party. Balloshi has the wright to block any account if it is confirmed that user has violated these terms.
• You grant Balloshi the right to prohibit the subsequent access, storage and reproduction or use of these content by any party to any extent Balloshi sees fit.

• You warrant that the holder of any rights, has completely and effectively waived all such rights and validly and irrevocably granted to you the right to grant the license in the preceding sentence

Balloshi and its subsidiaries, affiliates, successors, assigns, employees, agents, directors, officers and shareholders hereby exclude, to the fullest extent permitted by law, any and all liability which may arise from any content uploaded to the website by users, including, but not limited to, any claims for infringement of intellectual property rights, rights of privacy or publicity rights, any claims relating to publication of defamatory, obscene or offensive material, or any claims relating to the completeness, accuracy, currency or reliability of any information provided by users of Balloshi. By using Balloshi.com, you irrevocably waive the right to assert any claim with respect to any of the foregoing against Balloshi or any of its subsidiaries, affiliates, successors, assigns, employees, agents, directors, officers or shareholders.

Balloshi operates the Website as an online midway portal for buyers, sellers, consumers and community members. Balloshi does not sell any item listed on the Website directly and is never a party to any transaction between buyers and sellers. As a result, Balloshi does not (a) guarantee or ensure any item listed on the Website or any transaction between a buyer and seller, (b) collect or process payment or transfer of title on behalf of buyers or sellers, or (c) warehouse, store, ship or deliver any item listed on the Website. Furthermore, Balloshi is not responsible for, nor holds itself out as promoting, any interaction or dealing between you and one or more other user(s) of the Website, and Balloshi will not be liable in any way for any such interactions or dealings.

As such by using Balloshi, you agree not to hold Balloshi responsible for other users' content, actions or inactions, items they list or the destruction of allegedly fake items. We have no control over and do not guarantee the quality, safety or legality of items advertised, the truth or accuracy of users’ Content or listings, the ability of sellers to sell items, the ability of buyers to pay for items, or that a buyer or seller will actually complete a transaction or return an item. You acknowledge that you are solely responsible for evaluating and verifying the accuracy of any Content posted on the website under your full responsibility.

Blocking, Removal of Content and limitation of use and access

Balloshi provides your access to the website on a non-exclusive, temporary and revocable basis, and we reserves the right to withdraw or amend your right to access to the website without notice for any reason without prior notice. Balloshi will not be liable if for any reason the website is unavailable to you at any time or for any period for any reason and it is not responsible for any damages of any sort that may happen subsequently because of its unavailability.

All users have control over the content that they post and they may remove, edit any or all of their posted ads at any time once they log in to their account. Although, Balloshi may establish any limitations, in our sole discretion, on your usage of the website, including, but not limited to, limitations on the length of time that content may remain on the website, the file size of an individual item of content, number of items of content that can be posted. Balloshi reserves the right to modify, block, remove or delete any content or account at any time without any upfront notice, and to limit or restrict access to any content, for any reason and without liability whatsoever, including without limitation, if we have reason to believe that such content does or might infringe the rights of any third party, has been posted in breach of these Terms of Use or any applicable law in your country, or is otherwise unacceptable to Balloshi. Balloshi will have no liability to you or any third party if your access is terminates or if you are blocked from using the website or in the event that you are unable to access an item of content, including your posted contents, due to its removal from the website.

Balloshi may provide you with access to third party websites, servers, information, software, programs, systems, directories, applications, products or services. Balloshi does not have or maintain any control over external services or third party sites, and is not and cannot be responsible for their content, operation or use. By linking or otherwise providing access to any external services or third party sites, Balloshi does not give any representation, warranty, express or implied, with respect to the legality, accuracy, quality or authenticity of content, information or services provided by such external services links and accept no responsibility for them or for any loss or damage that may arise from your use of them.

Please refer to the privacy policy in the footer of the main website and in the help section of the mobile website before you finish reading these terms. You agreed that by the end of reading these terms you have read the privacy policy section and agreed on its terms

Infringement of proprietary rights

By using Balloshi, you agree not to post content that violates any international, federal, national, local copyright, patent, trademark or other intellectual property laws. Balloshi may, but is under no obligation to, screen or monitor any content and as such we have no liability or responsibility whatsoever to users for such violations. Balloshi is not responsible for any content submitted by a user that infringes another’s proprietary rights. Only the intellectual property rights owner can submit a report of potentially infringing items or listings, as such, if you have a good faith belief that a listing on Balloshi infringes your copyright, trademark, or other intellectual property rights, you can contact us. We reserve the right to remove content where we have grounds for suspecting the violation of these terms, our policies or of any party's rights.

Liability

We do not accept any liability for monitoring our website or for unauthorized or unlawful content on Balloshi or use of Balloshi by users. Please contact us to tell us about any problems or offensive content so that together we can keep the site working properly.

Balloshi services is offered without warranty and is provided on an “as is, as available” basis. Most of the stuff on Balloshi comes from other users, we do not guarantee the accuracy of postings or user interactions and communications or the quality, safety, or legality of what is offered. We also cannot guarantee continuous or secure access to our services. As such you use the website at your own risk. Accordingly as you are using Balloshi in any ways, we expressly disclaim, to the extent legally permitted, all warranties representations and conditions, express or implied, including those of quality, merchantability, merchantable quality, durability, fitness for a particular purpose and those arising by statute. We are also not liable for any loss, whether of money (including profit), income or revenue, business, profits or contracts, or loss of data, goodwill, reputation and loss of wasted management or office time. In general, We are not liable for any other loss or any damage, direct or indirect or consequential, of any kind caused by your use of Balloshi or any websites linked to it and any materials posted on it, or caused by any user in connection with the website, even if you advise us or we could reasonably foresee the possibility of any such damage occurring.

Balloshi is not liable for any damages of any kind resulting to you or a third party from the use or the inability to use the website or from any services or goods acquired through the Website or from any content displayed on the Website.

We are not liable for any damages of any kind resulting to you or a third party from viruses or other technologically harmful material that may infect your computer equipment, programs, data or other proprietary material due to your use of the website or to your downloading of any material posted on it, or on any website linked to it.

Indemnity

You agree to indemnify, defend and hold harmless Balloshi, its shareholders, officers, directors, employees, and agents from any claims, actions, demands, damages, losses or attorney fees alleging or resulting from your use or misuse of the website or any content, your breach of these Terms of Use, your violation of any third party’s proprietary rights, or any disputes between you and one or more users connected to or arising from the website in any way.

Enforcement of terms of use

We may limit or terminate our service, remove hosted content, terminate users accounts and take technical and legal steps to keep users off Balloshi if we think that they are creating problems or acting inconsistently with the letter or spirit of our policies without any liabilities whatsoever on Balloshi as consequence of these actions.

Balloshi reserves the right to take any measures, that we believe are reasonably necessary or appropriate, to enforce and/or verify compliance with any of these Terms of Use (including, but not limited to, Ballosshi’s right to cooperate with any legal process relating to your use of the website, and/or a third party claim that your use of the website is unlawful and/or infringes such third party’s rights).

You agree that Balloshi has the right, without liability to you, to disclose any registration data and/or account information to law enforcement authorities, government officials and/or third parties, as Balloshi believes is reasonably necessary or appropriate to enforce and/or verify compliance with any of these terms of use (including, but not limited to Balloshi’s right to cooperate with any legal process relating to your use of the Website, and/or a third party claim that your use of the Website is unlawful and/or infringes such third party’s rights).

Balloshi’s delay or failure to exercise a right or act on a breach of these Terms of Use does not waive our right to do so in the future.

Governing Law & Dispute Resolution

UAE laws govern these terms. In the event of any disputes between you and Balloshi, we will try to resolve the dispute in an informal and friendly manner. If either party believes that the dispute cannot be resolved in such a manner, then the parties agree that either party may refer any dispute arising out of, or in connection with, these terms of use, including any question regarding its existence, validity or termination, to be finally settled by binding arbitration. Such arbitration shall be held under UAE governing laws.

The seat of arbitration shall be in Dubai International Financial Centre in Dubai, UAE. The arbitration award shall be final and binding on the parties. If the arbitral panel has not been formed, any party may seek interim relief from any court to which both you and Balloshi hereto do hereby submit for this limited purpose.

 

Balloshi’s Proprietary Rights

You agree that Balloshi is the sole owner or the licensee of all intellectual property rights in the website.  Balloshi website is protected by copyright laws, as such you may not copy, distribute, reproduce, sell, lease, assign, rent, sublicense, encumber any aspect of the website or any content (as defined in the content section above) unless licensed by Balloshi. You are not allowed or legally permitted to modify or create derivative works of any aspect of the website or any content (as defined in Content section above) other than with respect to your own content. You may not disassemble or decompile, reverse engineer or otherwise attempt to discover any source code contained in the website or any software or database connected to the Website. We will take all the legal steps to the maximum in case we find any violations of Balloshi’s proprietary rights

 

Modifications to Terms of Use

These Terms of Use are effective and applicable from January 1^st 2012. Balloshi reserves the right at any time and from time to time to update, revise, supplement or modify these Terms of Use and to impose new and/or additional rules, policies, terms and/or conditions on your use of the website (collectively referred to as “Additional Terms”). Such Additional Terms will be effective immediately and incorporated into these terms of use. Your continued use of the Website constitutes you acceptance of all such Additional Terms. Any Additional Terms are hereby incorporated into these Terms of Use by this reference.

 

Payment and refunds:

Balloshi has provided multiple options to process payment for balloshi services

• Payment through SMS messages: Balloshi has provided a simple fast way of processing payments through your cell phone by entering your cell phone number and get the amount charged to your cell phone bell. by using the cell phone payment, you agree to use your own cell phone number. the amount will be charged to (TPAY)
• Payment through credit card: Balloshi use SSL protocol to assure safety and security of payment. your credit card data will NOT be shared, sold to any other companies and they will not be stored in our servers. the payment will be billed to "PAYTABS SIMPLE" the intermediate providing company.
• Direct transfer: you can deposite the amount directly to our account that will be provided as an option, you can contact us and we will help you

Refund policy: Refund may not be possible if deemed not appropriate by balloshi. Refund will not be possible, if deemed appropriate by Balloshi team, before 45 days of cell phone or credit card payment. or 5 day of direct deposit payment. to ask for refund, you are kindly asked to contact us "see contact us section" through email or phone and provide a written detailed explanation of the case and a prove of payment and ID photocopy for us to initiate the case and reply to you in a timely fashion.
